A man arrested in September at the Red Gym for violating a court order to stay off the University of Wisconsin campus until May 2011 plead no contest to charges Wednesday.
Albert Wellstein, 51, was charged with resisting a police officer and misdemeanor bail jumping in May 2007 and knowingly violating a harassment restraining order to stay off the UW campus in September 2007.
Wellstein had previously been charged with two counts of sending threatening computer messages, one count of resisting a police officer in March 2007, one count of disorderly conduct and use of a dangerous weapon in May 2007, and one count of misdemeanor bail jumping in September 2007. These charges were dismissed but read in for purposes of sentencing.
When charges are read in, prosecutor Tim Kiefer said, the defendant "can't be sentenced to additional jail for it, but the conduct can go into the overall sentencing on the other charges, meaning that the conduct can be considered at the time of sentencing."
According to a circuit court criminal complaint in February 2007, Detective Cheryl Radzinski began conducting a harassment investigation regarding Wellstein, which originated at Wisconsin Public Television.
Radzinski contacted Wellstein, instructing him to refrain from contacting WPT staff members, she said. In response, Radzinski reportedly received life-threatening e-mails from Wellstein.
"I am going to put you in jail or in your grave," Wellstein wrote in a March 9, 2007, e-mail to Radzinski. In an earlier e-mail, he wrote, "I have been contacted by WPT about volunteering; I will forward this to them and I hope to hurt you."
Wellstein reportedly resisted when arrested for this offense in a library at Madison Area Technical College's downtown campus.
Detective Peter Grimyser reported to have approached Wellstein at his place of employment in May 2007. Wellstein then reportedly greeted him with a baseball bat in hand and yelled for others to "call the Madison police."
According to Grimyser, after he was able to handcuff Wellstein, a search for weapons and contraband revealed nothing.
Last September, UW Police Department officer Nick Banuelos reported Wellstein on the second floor of the Red Gym in clear violation of a harassment restraining order keeping him off the UW campus, which had been granted in June 2007.
Prosecutor Tim Keifer said he and defense attorney Michael Convey agreed to take the plea Wednesday but will allow Wellstein to appear Monday morning to make a victim impact statement.
Judge Stuart Schwartz said the potential punishments against Wellstein could add up to a maximum penalty of $21,000 and 21 months in prison.
The two attorneys decided upon joint sentencing recommendation, but Schwartz said he could still sentence Wellstein to the maximum amount allowed by law.
