Two of the men charged with felony murder in connection to a death outside Crave Restaurant and Lounge last December entered their initial pleas at the Dane County Courthouse Friday.
Attorney Dennis Burke entered an initial plea of not guilty for his client, Roynell Fuller, 19, of Madison.
“I’ve not seen the state’s case,” Burke said. “After today, they will give me their discovery. I haven’t had an option to review the surveillance video; I haven’t had a chance to read all of the witness statements.”
He added attorneys are not entitled to evidence outside of the criminal complaints until after the arraignment.
Attorney Chris Van Wagner, acting attorney for Ross Spang, 22, of Madison, stood mute for his partner Tracey Wood’s client. Judge Stuart Schwartz entered a not-guilty plea on Spang’s behalf.
“In 99 percent of felony cases, people plead not guilty at the arraignment, which leaves the option of entering a plea at a later time,” Burke said.
Eduardo Cademartori was killed by a single punch to the head on Dec. 7 outside of the Crave on the corner of State Street and Johnson Street. A confrontation allegedly began when Cademartori, who was intoxicated, attempted to take a beer out of Crave.
Spang, a Crave employee at the time, told police Cademartori punched him in the mouth outside the bar. Spang said he then returned to the bar with his mouth bleeding to tell the other two accomplices what happened, after which Spang, Fuller and Javonte Walters, 20, of Madison, allegedly pursued Cademartori.
In a previous interview with The Badger Herald, Joel DeSpain, spokesperson for the Madison Police Department, said the MPD believes Fuller threw the single punch which killed Cademartori.
Dane County Coroner John Stanley declined comment on the injuries sustained by Cademartori due to the case being under litigation.
On Jan. 26, Spang testified against Walters at his preliminary hearing. Walters, initially an unidentified perpetrator, is now also charged with felony murder.
At the end of the hearing, tapes of the incident taken from the MPD’s downtown surveillance camera were played which showed the three suspects confront Cademartori and Fuller throw the punch.
Dane County District Attorney Brian Blanchard said the city of Madison maintains tapes from different cameras installed downtown in heavily trafficked areas. He also added Corey Stephen, the assistant district attorney assigned to the case, asked Judge Steven Ebert, the judge of Walters’ hearing, to seal the tapes temporarily to protect the evidence.
According to Erin Ocelotl Montes, secretary for Ebert, Ebert found probable cause to bind the evidence.
If the evidence was not sealed, public opinion could interfere with a fair trial, Blanchard said, adding the release of the tapes could also cause emotional trauma to the Cademartori family.
“This is not a ‘who done it,’” Burke said. “The question is not so much what happened; the question is what do we do with these guys who were involved in this. That is the question that remains unresolved.”

Ross Spang is a real piece of work; 4 DUI’s by age 22, multiple fights, disturbing the peace, drugs, and constant lying. He’s unbelievable! He should get life in prison for this crime. Cademartori never laid a hand on him; if he did, why did Spang not hit him back right there and then? He’s such a liar! There is no doubt in my mind that he will kill again if he is out on the street.

Every one has a past… everyone! Whether it be good or bad. Ross is not on trial for his past so why are you talking about it. Everyone makes mistakes and i wouldnt say that anyone involved in this situation were completely inocent, including the victim. Dont paint him to be such a saint when there are witness’s to him punching Spang and also witness statments thats the guy also said he had a knife. All i know is that this is a very unfortunate instance of a bad choice, how many barfights are there downtown on anygiven weekend and we dont see it all over the media until someone dies, maybe this is the shock that madison needs to do something about this growing problem.

To “Everyone has a past…” Get your facts straight. There isn’t one witness who saw Eduardo Cademartori punch Spang at the bar. Not even one. However, there are multiple witnesses AND video evidence of Cademartori WALKING AWAY and Spang, Fuller, and Walters following him, assaulting him, and murdering him. Those kids took our friend…and he was a saint. you wish you had a friend like him.

There sure is a witness to “ed” punching spang. The BOUNCER standing right next to the two of them! why dont you get YOUR facts straight. And secondly what kinda saint runs arround in a town hes unfamiliar with and tells barstaff that hes going to stab them and assults them… sounds like this guy mouthd off to the wrong person. Im not saying he deserved to die but he’s not totaly inocent either. Like i said before this is an unfortunate tragedy, how many barfights are there in southern wisconsin on a given night, how many ufc fighters or boxers step in to the ring and take huge amounts of punishment… and no one dies from it the only reason this is a big deal is cause someone died otherwise youd of never ever heard about it!

The fact is that Sprang went back into the bar, got two more people to help him follow and then attack Cademartori from behind. That says to me the sniveling coward couldn’t do his own dirty work, but like other predators they have to travel in packs. Why didn’t he just let Cademartori keep walking? He was already out the area of Crave and he didn’t have the beer he supposedly tried to take out of the bar. One can only hope that these pieces of scum do a lot of years behind bars to ponder those questions.
